Introduction
Welcome to Remotivated. These Terms of Service ("Terms") govern your access to and use of the services provided by Remotivated LLC ("Remotivated," "Company," "we," "us," or "our"), including our website at www.remotivated.com, our job board, company directory, and any related services, features, content, or applications (collectively, the "Services").
These Terms constitute a legally binding agreement between you and Remotivated. Please read them carefully before using our Services.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
1. Definitions
"Company Profile" means a page on our Services displaying information about an employer, including but not limited to company description, remote work policies, benefits, culture information, and job listings.
"Content" means all text, images, graphics, logos, audio, video, software, data, and other materials available through the Services.
"Employer" means any organization that has job listings displayed on our Services or maintains a Company Profile.
"Job Listing" means any employment opportunity displayed on our Services.
"Job Seeker" means any individual who uses our Services to search for, view, or apply to job opportunities.
"User" means any individual or entity that accesses or uses our Services, including Job Seekers, Employers, Company Representatives, and visitors.
"User Content" means any content, data, or information that Users submit, post, or transmit through our Services.
2. Eligibility and Account Registration
2.1 Eligibility
To use our Services, you must:
- Be at least 16 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Services under applicable law
- Not have been previously banned from our Services
If you are using the Services on behalf of an organization, you must have the authority to bind that organization to these Terms.
2.2 Account Registration
Some features of our Services require you to create an account. When you register:
- You must provide accurate, current, and complete information
- You must maintain and promptly update your account information
- You must keep your login credentials confidential
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
2.3 Account Types
Our Services offer different account types:
Job Seeker Accounts: For individuals seeking employment opportunities. Job Seeker accounts allow you to save jobs, create job alerts, and manage your job search preferences.
Employer/Company Representative Accounts: For individuals representing organizations. These accounts allow you to claim and manage Company Profiles, view aggregate analytics about job listing performance, and communicate with Remotivated about your organization's presence on our platform.
You may not create multiple accounts of the same type or misrepresent your account type.
3. Description of Services
Remotivated provides a platform focused on remote and hybrid work opportunities. Our Services include:
3.1 Job Board
We aggregate and display job listings from employers who support remote or hybrid work arrangements. Job Seekers can search, filter, save, and apply to these opportunities.
3.2 Company Directory
We maintain profiles of companies that offer remote or hybrid work options. These profiles include information about company culture, remote work policies, benefits, and other relevant details to help Job Seekers make informed career decisions.
3.3 Job Alerts
Registered users can save searches and receive notifications when new jobs matching their criteria are posted.
3.4 Company Verification and Certification
We offer two levels of recognition for employers on our platform:
Verified Status: Employers can claim their Company Profile at no cost by verifying their association with the company. Verified companies can confirm and update their basic profile information.
Certified Status: We offer a certification program recognizing employers who demonstrate excellence in remote work culture and practices. Certified companies receive enhanced recognition and visibility on our platform, with additional benefits available through our certification packages.
3.5 Testing and Improvements
We continuously work to improve our Services. This may include conducting tests, experiments, or feature variations to evaluate and enhance user experience. Your participation in such tests is part of normal Service use and helps us improve our platform for all users.
3.6 Additional Services
We may offer additional services, features, or content from time to time. Such services may be subject to additional terms, which will be presented to you at the time of use.
4. Job Seeker Terms
4.1 Job Search and Applications
When using our Services as a Job Seeker:
- Job listings are provided for informational purposes. We do not guarantee the accuracy, completeness, or availability of any job listing.
- When you click "Apply" on a job listing, you will typically be redirected to the Employer's website or applicant tracking system to complete your application.
- We are not a party to any employment relationship between you and an Employer.
- We do not screen, interview, or make hiring decisions. Those decisions are made solely by Employers.
- We do not guarantee that you will receive a response from any Employer or that you will be hired for any position.
4.2 Saved Jobs, Alerts, and Following
- You may save job listings and searches to your account for future reference.
- You may follow companies to stay updated on their profiles and job listings.
- Job alerts are sent based on the preferences you configure. You can modify or disable alerts at any time.
- Saved jobs may become unavailable if the Employer removes the listing or the job is filled.
4.3 Your Responsibilities
As a Job Seeker, you agree to:
- Provide accurate information in your profile and any applications
- Use the Services only for legitimate job search purposes
- Not misrepresent your qualifications, experience, or identity
- Comply with the application requirements of each Employer
- Not use the Services to harass, spam, or send unsolicited communications to Employers
5. Employer and Company Representative Terms
5.1 Company Profile Claims
If you represent a company listed on our Services, you may claim your Company Profile by:
- Verifying your association with the company using your work email address
- Providing accurate information about yourself and your role
- Completing our verification process
We reserve the right to approve, deny, or revoke any claim at our discretion. Unverified claims expire after 7 days.
5.2 Profile Accuracy
If you manage a Company Profile, you represent and warrant that:
- You have the authority to act on behalf of the organization
- Information you provide about the organization is accurate and not misleading
- You will promptly update information when it changes
- You will not misrepresent the organization's remote work policies, benefits, or culture
5.3 Job Listings
Job listings displayed on our Services may be:
- Aggregated from Employer websites and applicant tracking systems
- Submitted directly by Employers or their representatives
- Sourced from third-party job data providers
We make reasonable efforts to ensure job listings are current and accurate, but we do not guarantee their accuracy or availability.
5.4 Analytics
We provide Employers with aggregate analytics about their job listings and Company Profile, such as the number of views and application clicks. This data is provided in aggregate form and does not identify individual Job Seekers.
5.5 Employer Responsibilities
As an Employer or Company Representative, you agree to:
- Provide accurate and non-discriminatory job listings
- Comply with all applicable employment laws and regulations
- Not post fraudulent, misleading, or illegal job listings
- Respond to applicants in a professional and timely manner
- Not use personal information obtained through our Services for purposes unrelated to employment
- Not discriminate against applicants on the basis of race, color, religion, sex, sexual orientation, gender identity, national origin, disability, age, or any other protected characteristic
6. User Content and Contributions
6.1 Your Content
You retain ownership of any content you submit to our Services ("User Content"). By submitting User Content, you grant Remotivated a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Services and our business operations.
6.2 Content Standards
You agree that your User Content will not:
- Be false, misleading, or deceptive
- Infringe any third party's intellectual property or proprietary rights
- Violate any person's privacy or publicity rights
- Be defamatory, obscene, abusive, or harassing
- Promote discrimination, hatred, or violence
- Violate any applicable law or regulation
- Contain viruses, malware, or other harmful code
- Constitute spam or unauthorized advertising
6.3 Feedback and Suggestions

7. Company Profiles and Content

Company Profiles on our Services are created and maintained using:
- Publicly available information from company websites, press releases, and public filings
- Information from third-party business data providers
- Information submitted by Employers or their representatives
- User reviews and feedback (where applicable)
- Our own research and analysis
7.2 Accuracy and Corrections
We strive to provide accurate information but cannot guarantee the completeness or accuracy of Company Profiles. Information may be outdated, incomplete, or incorrect.
If you represent a company and believe information on your Company Profile is inaccurate:
- You may claim your profile and submit corrections through your account
- You may contact us at hello@remotivated.com
We will review correction requests and make updates at our discretion. We are not obligated to implement all requested changes.
7.3 Opinions and Ratings
Company Profiles may include ratings, scores, or assessments developed by Remotivated or based on third-party data. These represent our analysis and opinions and are provided for informational purposes only. They do not constitute endorsements or guarantees.
7.4 Featured and Certified Companies
Some companies may be featured prominently or identified as "Certified" based on our certification program or other criteria. Featured placement or certification status does not constitute an endorsement of any particular company as an employer. Job Seekers should conduct their own research before accepting employment.
8. Intellectual Property Rights
8.1 Our Content and Marks
Remotivated owns or licenses all intellectual property rights in our Services, including:
- The Remotivated name, logo, and brand elements
- Website design, layout, and user interface
- Software, code, and underlying technology
- Text, graphics, images, and other content we create
- Data compilations and databases
- Certification badges, seals, and related materials
These materials are protected by copyright, trademark, and other intellectual property laws.
8.2 Restrictions
Except as expressly permitted by these Terms, you may not:
- Copy, reproduce, or distribute our Content
- Modify, adapt, or create derivative works
- Reverse engineer, decompile, or disassemble our software
- Remove or alter any proprietary notices
- Use our trademarks or branding without permission
- Frame or mirror any part of our Services
- Use our Content for commercial purposes without authorization
8.3 DMCA and Copyright Complaints
If you believe that content on our Services infringes your copyright, please send a notice to hello@remotivated.com containing:

9. User License
9.1 Grant of License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

- View and download Content for personal, non-commercial use
- Save and print job listings for your personal job search
9.2 Restrictions
This license does not permit you to:
- Use the Services for any commercial purpose without our consent
- Access the Services through automated means (bots, scrapers, etc.)
- Collect or harvest data from the Services
- Resell, sublicense, or redistribute the Services or Content
- Use the Services to compete with Remotivated
9.3 Revocation
We may revoke this license at any time, with or without cause, by terminating your access to the Services.
10. Prohibited Activities
You agree not to engage in any of the following activities:
10.1 Harmful Conduct
- Using the Services for any illegal purpose
- Harassing, threatening, or intimidating other Users
- Impersonating any person or entity
- Posting false, misleading, or fraudulent content
- Interfering with other Users' enjoyment of the Services
10.2 Technical Violations
- Attempting to gain unauthorized access to our systems
- Circumventing security measures or access controls
- Introducing viruses, malware, or other harmful code
- Overwhelming our infrastructure with excessive requests
- Using automated tools to access or interact with the Services without permission
10.3 Data and Content Violations
- Scraping, crawling, or harvesting data from the Services
- Copying or redistributing our Content without authorization
- Creating derivative databases from our data
- Using data obtained from the Services for spam or unsolicited communications
- Collecting personal information about other Users without their consent

- Posting job listings for positions that do not exist
- Using the Services to recruit for competitors
- Reselling access to the Services

- Suspension or termination of your account

We do not:
- Control or endorse third-party websites
- Guarantee the accuracy of third-party content
- Accept responsibility for third-party privacy practices
- Assume liability for your interactions with third parties
11.2 Third-Party Services
Some features may integrate with third-party services (such as social login providers). Your use of those services is governed by their respective terms and privacy policies.
11.3 Job Applications
When you apply to jobs through our Services, you will typically be redirected to the Employer's website or applicant tracking system. Your application and any information you provide is subject to the Employer's terms and privacy policy, not ours.
12. Disclaimers
12.1 "As Is" Basis
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
12.2 No Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES OF NON-INFRINGEMENT

12.3 Job Listings and Employment
WE DO NOT WARRANT THAT:
- ANY JOB LISTING IS ACCURATE, CURRENT, OR AVAILABLE
- YOU WILL RECEIVE A RESPONSE FROM ANY EMPLOYER
- YOU WILL BE HIRED FOR ANY POSITION
- ANY EMPLOYER WILL MEET YOUR EXPECTATIONS
- INFORMATION ABOUT EMPLOYERS IS ACCURATE OR COMPLETE
12.4 No Employment Relationship
REMOTIVATED IS NOT AN EMPLOYMENT AGENCY, STAFFING FIRM, OR RECRUITER. WE DO NOT:
- SCREEN, INTERVIEW, OR EVALUATE JOB SEEKERS
- MAKE HIRING DECISIONS
- GUARANTEE EMPLOYMENT OUTCOMES
- CREATE ANY EMPLOYMENT RELATIONSHIP BETWEEN YOU AND ANY EMPLOYER
12.5 Third-Party Content
WE ARE NOT RESPONSIBLE FOR ANY CONTENT PROVIDED BY EMPLOYERS, JOB SEEKERS, OR OTHER THIRD PARTIES. YOU USE SUCH CONTENT AT YOUR OWN RISK.
13. Limitation of Liability
13.1 Exclusion of Damages
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL REMOTIVATED, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
- ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES
- ANY DAMAGES ARISING FROM CONDUCT OF THIRD PARTIES ON THE SERVICES
- ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
13.2 Cap on Liability
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR
- ONE HUNDRED DOLLARS ($100)
13.3 Basis of the Bargain
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13.4 Jurisdictional Limitations
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
14. Indemnification
You agree to indemnify, defend, and hold harmless Remotivated and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third party's rights
- Your User Content
- Your interactions with Employers, Job Seekers, or other Users
- Any employment relationship you enter into through the Services
We reserve the right to assume exclusive control of the defense of any claim subject to indemnification, at your expense. You agree to cooperate with our defense of such claims.
15. Term and Termination
15.1 Term
These Terms are effective when you first access or use the Services and remain in effect until terminated.
15.2 Termination by You
You may terminate your account at any time by:
- Using the account deletion feature in your account settings, or
- Contacting us at hello@remotivated.com
15.3 Termination by Us
We may suspend or terminate your account or access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Conduct harmful to other Users or our business
- Extended periods of inactivity
- Requests from law enforcement
15.4 Effect of Termination
Upon termination:
- Your right to use the Services immediately ceases
- We may delete your account data (subject to our data retention policies)
- Any outstanding obligations or liabilities survive termination
- Sections of these Terms that by their nature should survive will continue in effect
15.5 No Refunds
Termination does not entitle you to any refund of fees paid, unless otherwise specified in writing.
16. Paid Services and Payment Terms
16.1 Free and Paid Features
Many features of our Services are available free of charge. We may offer premium features, enhanced services, or additional functionality for a fee ("Paid Services").
16.2 Pricing and Payment
If you purchase Paid Services:
- Prices will be disclosed before purchase

16.3 Subscription Services
For subscription-based Paid Services:
- Subscriptions automatically renew unless cancelled
- You may cancel at any time before the next billing cycle
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial billing periods
16.4 Late Payments
For business accounts with invoiced billing:
- Payment is due upon receipt unless otherwise specified
- Late payments may incur interest at 2% per month
- We may suspend access for non-payment
- You are responsible for collection costs, including reasonable attorneys' fees
16.5 Taxes
You are responsible for all applicable taxes. If we are required to collect taxes, they will be added to your invoice.
17. Verification and Certification Programs
17.1 Overview
Remotivated offers two levels of recognition for employers:
Verification is a free service that allows employers to claim their Company Profile, confirm their company information, and maintain an accurate presence on our platform.
Certification is a premium program recognizing employers who demonstrate excellence in remote work culture and practices. Certified companies receive enhanced recognition, visibility, and marketing benefits.
17.2 Verification Process
Any employer representative may verify their Company Profile by:
- Claiming the profile using their work email address
- Confirming basic company information is accurate
- Completing our verification process
Verification is provided at no cost and does not imply endorsement of the company's remote work practices.
17.3 Certification Process
Certification involves:
- Application and screening process
- Assessment of remote work policies and practices
- Employee engagement surveys (where applicable)
- Review by Remotivated staff
Certification decisions are made at Remotivated's sole discretion.
17.4 Certification Packages
Certified employers may select from available certification packages (such as our "Certify" and "Celebrate" packages), each offering different levels of benefits including:
- Display of certification badges on their Company Profile
- Enhanced visibility in search results and directories
- Marketing materials and digital assets
- Additional promotional opportunities (varies by package)
Specific benefits are detailed in the certification agreement for each package.
17.5 Badge Usage
If your organization earns verification or certification:
- You may display the applicable badge for the period it was earned
- You must use badges as provided, without modification
- Verified companies may not represent themselves as Certified
- Certified companies may not imply certification for years not earned
- Badge usage rights terminate if the status expires or is revoked
17.6 Post-Certification Rights
Upon termination of your certification or agreement with Remotivated:
- You may continue to display the certification badge ONLY for the specific year(s) it was earned
- You must clearly indicate the year of certification
- You may not use the badge in a way that implies current certification status
- You may continue to use data points or infographics provided during certification, provided the appropriate year's badge is displayed prominently alongside
- All other rights to use Remotivated intellectual property are revoked immediately
Unauthorized use of verification or certification badges or intellectual property may result in legal action and claims for damages.
18. Promotions and Referrals
18.1 Partner Programs
We may partner with other organizations to provide additional value to our users. Some partnerships may involve:
- Promotional offers or discounts
- Integration with third-party services
- Referral compensation or incentives
We are not obligated to disclose all financial arrangements with partners.
18.2 Employee Referral Promotions
We may offer incentives to employees who nominate their employer for our certification program. To qualify:
- Nominations must be made during an active promotional period
- The nominated company must become a paying client within 180 days
- The referring employee must be employed at the nominated company at the time of referral and certification
- Complete and accurate information must be provided
- The referring employee must not have elected to remain anonymous
Incentives will be delivered within 30 days of qualification (or longer for physical products). We reserve the right to substitute incentives of comparable value. Failure to respond to delivery requests within 30 days forfeits the incentive. In cases of multiple qualified referrals from the same organization, the first qualifying referral receives the incentive.
18.3 Promotional Terms
Specific promotions may have additional terms and conditions, which will be disclosed at the time of the promotion. In case of conflict, promotion-specific terms prevail.
19. Dispute Resolution
19.1 Informal Resolution
Before initiating formal dispute resolution, you agree to contact us at hello@remotivated.com and attempt to resolve any dispute informally for at least 30 days.
19.2 Binding Arbitration
If informal resolution fails, any dispute arising from these Terms or the Services shall be resolved through binding arbitration administered by an arbitrator of our choosing. The arbitration will be conducted in English, and the substantive law of New Hampshire shall apply.
19.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
19.4 Exceptions
The following disputes are not subject to arbitration:
- Disputes regarding intellectual property rights
- Disputes involving allegations of theft, piracy, or unauthorized use
- Claims for injunctive relief
Such disputes may be brought in courts of competent jurisdiction in New Hampshire.
19.5 Governing Law
These Terms are governed by the laws of the State of New Hampshire and the United States, without regard to conflict of law principles.
19.6 Jurisdiction
For matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in New Hampshire.
20. General Provisions
20.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and Remotivated regarding the Services.
20.2 Modifications
We may modify these Terms at any time by posting the revised Terms on our Services. Changes are effective when posted. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.
For material changes, we will provide notice through the Services or by email. It is your responsibility to review the Terms periodically.
20.3 Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it later. Any waiver must be in writing and signed by Remotivated.
20.4 Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
20.5 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
20.6 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except as explicitly stated.
20.7 Force Majeure
We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control.
20.8 Electronic Communications
By using the Services, you consent to receive electronic communications from us. You agree that any notices, agreements, disclosures, or other communications delivered electronically satisfy any legal requirement that such communications be in writing.
20.9 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
20.10 Survival
The following sections survive termination: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive.
